    Opinion and Order of the Board (by Mr. Currie):
    Cedar Park was granted a variance last year to allow the
    open burning of a number of diseased trees
    (#
    71—38, (April
    14, 1971)). A second application for burning additional trees
    has been made. We dismiss the petition on the ground that even
    if all the allegations were proved the variance could not be
    granted.
    Our regulations regarding open burning have been amended
    since we entertained the previous application from Cedar Park.
    We held extensive hearings in which the necessity for burning
    diseased trees was established and generous procedures adopted
    to provide for such burning with as little harm to the
    environment as is practicable. The regulations now allow such
    burning, by permit, either with the aid of an air—curtain destructor
    or outside metropolitan areas, on a permit granted by the
    Agency. No sufficient reason is given why these measures can-
    not be availed of to minimize the harm to the environment while
    disposing of diseased trees. The small extra cost noted in the
    petition is insufficient to justify burning inside the City.
    All are expected to make some sacrifices in order that the air
    will be fit to breathe. The petition is hereby dismissed.
