Opinion and Order of
the Board

Ravinia asks
to burn “over twenty” diseased
elms despite
the
open burning regulations.
No permit could be obtained since
the site
is within
a restricted area.
The regulations allow burning of trees
if done sufficiently
remotely or
with
the aid of an air-curtain destructor, which
essentially eliminates
smoke.
Ravinia
has not alleged any reason
why
iL cannot get rid of
its
trees without open burning
in
a
congested area, either by utilizing
a destructor
(its own or some-
one else’s)
or by moving the material
to
a more acceptable
site.
We note
in
this regard the variance today granted to the Forest
Preserve District
of Cook County
to conduct
a substantial burn-
ing operation near Wheeling (~71-3O4).
The restricted-area provision
was put
in the regulations for
a reason,
and it cannot simply
be ignored.
We hereby dismiss the petition without prejudice
to
the filing of another that addresses itself to the inability
of complying with
the regulation conditions
for open burning.
