    ENVIRONMENTAL PROTECTION AGENCY
Opiniqn a1~dOrder of the Board (by Mr. Currie):
    On May 3, 1971 (## 70-39, 71-18) we ordered LaForge to
terminate its discharge of polluted rendering plant effluent
    to th~ at~iica~Riverby October 8, 1971, the expected date
for cozinection~tothe Freeport municipal sewer In September
    the compa~I~ ~avariance petition asking a two—month
    ex-
    tension
I~éc~isecxf.prbb~Iemswith its contractor, who had been
replaced. The petition noted that the interim chlorination
facility required by our order had been successfully installed.
    The December 8 compliance
    cLc~e
    requested has now passed,
and the present request is therefore essentially moot. LaForge
remains subject to its obligation to submit progress reports,
and we shall expect confirmation that the project has indeed
been completed. If it has not been, the agency remains free
to institute an appropriate proceeding. The petition is dis-
    missed. Cf. National Gypsum Co. v. EPA, # 71—B9 (Aug. 2, 1971).
I, Christan Moffett, Acting Clerk of the Pollution Control Board,
certify that the Board adopted the above Opinion and Order
of the Board this 21st day of December, 1971 by a vote of 4—0.
