ILLINOIS
POLLUTION CONTROL BOARD
December
9,
1971
CARRIE
F. ANDRACKI
et al.
v.
)
#
71—376
ENVIRONMENTAL PROTECTION AGENCY
Opinion and Order of the Board
(by Mr.
Currie)
The oetitioners seek reconsideration of our denial
(Andracki
V.
EPA,
# 71—149,
September
2,
1971)
of
their re-
quest for
a variance
jo permit
a connection to an overloaded
treatment plant in the North Shore Sanitary District.
The reasons
for our action
are explained
in our earlier opinion,
and no
new
facts are alleged that would cause us to take the unusual
step of trying
the case over
a second
time.
We note
that
a petition
is
now pending before us
in which the District
seeks partial relaxation
of
the sewer connection order on the
ground of alleged improvements
to the treatment processes.
Such
a case as
is alleged by the present petitioners would
clearly merit strong consideration
from the District in the
event
its own petition should be granted.
The petition
in
71—376
is hereby dismissed.
I, Christan Moffett, Acting Clerk of the Pollution Control
Board,
certify that
the Board adopted the above Opinion and
Order this
9th
day of December,
1971.
