Order of the Board (by Mr. Currie):
The petition seeks permission to connect an exist-
ing home to a Waukegan sewer, which apparently is over-
loaded in wet weather within our order in NSSD v. EPA,
*71—343, 3 PCB 541 and 697 (Jan. 31 and Mar. 2, 1972).
An attached letter from the Lake County Health Depart—
rnent shows that an existing septic tank has been ren—
dered inadequate by changes in surface drainage, re-
sulting in inadequately treated sewage on the petitioner’s
property. In similar cases we have granted variances
without hearing, Winsor V. EPA, *71-334, (Nov. 23, 1971).
We notified the Agency of our intention to decide the
case as rapidly as possible without hearing and asked
for a recommendation within 21 days. No objection
having been received, the variance is hereby granted
to eliminate the obvious health hazard.
