Opinion of the Board (by Mr. Currie)
Chicago Vitreous Corp. manufactures porcelain enamel
frits principally forthe appliance industry. It petitions for
confirmation of an Air Contaminant Emission Reduction Program
approved by the Air Pollution Control Board for bringing
particulate emissions into compliance with regulations.
Completion of the program has been delayed a few weeks but
is expected by December 15 of this year. Because of the brief
time involved we thought it not worthwhile to incur the ex-
pense and trouble of a hearing. The Agency’s recommendation
is that we grant the variance subject to the company’s having
a stack test performed and subject to the submission of information
and control programs for other plant sources. We shall do so,
omitting the usual bond requirement because the varaince is
to expire almost before a bond could be filed.
ORDER
Chicago Vitreous Corp. is hereby granted a variance to permit
the emission of particulate matter in excess of regulation limits
from its smelters numbered 4, 5, 7, and 8, until December 15,
1971, on the following conditions:
1. The submission of a report of stack tests under normal
operating conditions not later than January 15, 1972;
2. The submission of a report as to the status and
control plans for other potential contaminant sources
in the plant by January 15, 1972;
3. As agreed in the petition, until the control equipment for
the smelters included in this variance is operative, the
smelters shall not be operated during times when adverse
weather conditions create a hazard of nuisance.
