Preliminary Order of the Board (by Mr. Currie)
This citizen complaint charges the City with allowing
raw sewage to escape its sewers into basements. Though it
is designated a “formal” complaint, we cannot tell whether
or not the complainants wish us to schedule a hearing in
which they must prove their case. Nor have we any indication
that the respondents have been properly served as required
by our rules to afford opportunity to defend. The complaint
also fails to specify what provisions of the law are violated
by the acts complained of. We shall allow 21 days from this
date for submission of an amended complaint, failing which we
shall refer the matter to the Environmental Protection
Agency for investigation.
