Petitioner

seeks

a variance

to allow the open burning of non—

diseased trees

and underbrush to clear approximately twenty—two

acres of land

at the edge of the City

limits.

Under our recently—

adopted regulations,

the proper and more expeditious method of

handling open burning cases ~is by referral to the Environmental

Protection Agency which has been authorized

to grant or deny

permits

to burn in the open.

A copy of the new regulation detailing

the permit procedure will he sent

to the Petitioner with this order

and we trust that

the Agency will give expedited consideration to

this

The petition is hereby dismissed without prejudice.
