ILLINOIS POLLUTION CONTROL BOARD
September

 1972
IN MATTER OF REPEAL
OF ENFORCEMENT TRANSCRIPT
 )
 #R72-l3
REGULATION
OPINION OF THE BOARD
 (BY SAMUEL
 T. LAWTON,
 JR.)
Pursuant to notice published in Newsletter #50 dated July 14,
1972, we have this day repealed Rule 328 of Chapter
 I of the
Rules and Regulations of the Illinois Pollution Control Board
adopted on March
 2,
 1972,
as #R72-l, and have substituted a new
Rule 328 in its place.
This procedural rule required court report-
ing costs in enforcement proceedings to be apportioned among the
parties.
Since the Board has received additional funding enabling
it
to assume the cost of enforcement transcripts,
 the rule
 is
no longer necessary,
 and accordingly, has been repealed.
 The
new rule substituted
 in
lieu thereof as Rule 328 requires the
Board
to furnish the transcript at its cost, as originally re-
quired pursuant to Rules of the Board adopted on October 16,
1970.
While the Board has proposed repeal of Rules 410 and 505
pertaining
to the furnishing of transcripts in variance and permit
cases
 (~R72-l2,June 21,
 1972)
by the parties, we are deferring
action
on these matters for the present
 time.
