OPINION
OF THE BOARD

Beloit Foundry Company
(“Beloit”)
seeks
an
extension
until
August
11,
1972 to comply with the March
20, 1972 deadline imposed
by the Board in its Order of October
28, 1971 in PCB 71-101.
That
Board Order directed that Beloit pursue
with diligence
a program
intended to bring its particulate emissions from a gray
iron cupola
into compliance with the applicable state
standards.
Beloit’s pro-
gram contemplates the installation of
a baghouse,
afterburner and
associated equipment.
Beloit contends that
the
five-month delay
in completing
in-
stallation
is attributable
to suppliers’
late delivery and strikes
at
the
equipment manufacturers.
Several items
of
correspondence
submitted with the variance application substantiate Beloit’s dili-
gence
in
seeking to obtain expedited delivery.
In addition, Beloit
has
installed most of the control equipment which has been delivered
to
it.
The Agency recommends that the variance be granted since
the delay
in installation has not been due to Beloit’s negligence,
but rather to delays over which Beloit had no control,and since
Beloit has shown diligence in installing the equipment upon arrival.
We agree, but will impose the conditions which the Agency
recommends:
keeping the $150,000 performance bond in force and
effect;
and submitting monthly progress reports to the Agency.
ORDER
Beloit Foundry Company is hereby granted a variance until
August
11,
1972
from Paragraph

of the Board order in PCB
71-101,
decided October
28,
1971,
subject to the following conditions:
1.
Beloit shall keep
in
force and effect the $150,000
performance bond~utilsuch time
as the
emission
control system is
c~mplete.dand meets Agency approval
as
to
its satisfactory operation.

Beloit shall submit monthly progress reports
to the Agency.
3.
Beloit shall act with utmost diligence and
expedition
in completing the emission control
program.
