ALUMINUM COIL ANODIZING CORPORATION
Preliminary Order on Motion for Non—Disclosure
(by Mr. Currie):
Aluminum Coil moves that certain information the Agency
seeks
to obtain by discovery be stamped for non—disclosure
pursuant to section 7(a)
of
the Environmental Protection Act
and to our Procedural
Rule 107.
This motion raises new and
important questions as to the interpretation of the non—disclosure
provisions, which limit an important statutory policy favoring
public access to information.
We believe the parties should
have full opportunity
to present their views.
If either party
wishes to introduce evidence on the issues,
the Hearing Officer
shall be
so notified on or before June
12,. 1972,
and upon such
notification shall set a prompt date for hearing such evidence.
Briefs shall be submitted on or before June
20,
1972,
or such
other date as~theHearing Officer shall determine.
The Hearing
Officer may permit a short time for the filing of reply briefs.
As provided by
Rule 107, the information shall
not be disclosed
beyond the parties pending resolution of this motion.
