Opinion & Order of the Board (by Mr. Currie):
On October 14,. 1971, we granted National Starch a variance
from the applicable BOD and suspended solids while constructing
additional treatment facilities, on several conditions including
a money penalty for past delays. The opinion and order con-
templated that the construction program would be completed by
the end of 1972, but because the statute requires annual re-
approval of variance programs the variance was granted only
until October 1, 1972, with leave to apply for reapproval upon
a showing of satisfactory progress. National Starch & Chemical

The present peititon reports that all conditions of the
order have been met and that construction is proceeding on
schedule. The Agency’s recommendation confirms these allegations.
As originally contemplated, therefore, we hereby extend the
variance granted in#71-83 to December 31, 1972.
