ORDER
The City of Highwood has petitioned for variance of SWB-7
and the Rules and Regulations of the Board relating to water pollu-
tion with respect to the waste water discharge from the City’s water
filtration plant. SWB-7 requires that this facility be in compliance
by July 1, 1972.
No allegations appear in the petition justifying the delay in
compliance. We have held in previous cases that such a showing is a
necessary element to the granting of a variance. See Decatur Sanita~~
District v. Environmental Protection A~ency, #71-37. Rather than dis-
miss the petition, we will grant the City twenty days from the date
of this Order to submit a statement of such facts which it believes
serve as justification for the City’s failure to meet the requisite
deadline.
We do so in order that when the record is received by the Board,
it will not be deficient in this respect.
