Petitioner seeks

a variance,

to burn

a limited quantity of contaminated aviation

fuel for

purposes of training in firefighting techniques.

Under

our

revised regulations adopted September

Agency may grant

a permit for such burning,

and no variance

is

needed

in

the absence of

a showing

that such

a permit has been

sought and denied.

No such allegations having been made,

there

is

no case here

for

a variance, and the petition

is

hereby dismissed.
