Opinion
& Order of the Board on Request for Extension

Our order
of February
3,
1972 found that Holland had violated
certain provisions respecting the discharge
of wastewater
and
ordered
the company to submit
a program by March
1 for achieving
compliance.
At that time
the company’s preference,
if feasible,
was to connect to municipal
sewers tributary
to
a treatment
plant.
On February 25 Holland reported its progress
in seeking
a solution,
including its conclusion that
the municipal connection
cannot be confidently predicted
at this
time and therefore that
it must proceed to construct
its own additional treatment
facilities.
A preliminary engineering study has been made,
and Holland
asks an extension of
60 days
in which to complete
development of the control program.
The Agency recommends that
this extension be granted, and we agree.
The company has been
working diligently to correct
its problems since the entry of
our initial order, and has been
forced to abandon
its original
plan of connecting to the city sewer.
The additional
two months
are necessary
to permit the details of the program to be worked
out and
a permit applied
for.
We read the company’s February
24 request as
a commitment
to construct as rapidly as
is practicable
facilities adequate
to bring discharges into full compliance.
ORDER
Paragraph
3 of the Board’s order of February
3,
1972,
is hereby amended by substituting “April 30,
1972” for”March
1,
1972” with respect to the date for submission of
the required
compliance program.
Such program shall be submitted
to the Agency
as well as
to the Board, and
shall be accompanied by an application
for
a permit
to construct the proposed facilities.
In all other respects the order of February
3,
1972,
shall
remain in full force
and effect.
