Order of the Board on Motion

for Stay

(by Mr.

Currie):

The District asks us to stay enforcement of our order

in

this case pending judicial review.

As in prior cases,

and in

accord with the Agency’s recommendation, we hereby stay payment

of the money penalty,

on condition that

a bond be posted with

the Agency assuring payment of the penalty with interest in the

event of

a court decision adverse

to the District on that issue,

and deny the motion in all other respects.

Mr. Kissel took no part

in the consideration or

decision of this case.

I, Christan L. Moffett, Clerk of the Pollution Control Board

certify that the Board adopted the above Order on Motion for

Stay this 14th day of March, 1972 by a vote of 4-0.
