A
citizens~complaint was filed by Mr. and
Mrs.
Raymond E.
Donaldson on October 17,
1972
against the City of Elmhurst, alleging
that as
a consequence of inadequate sewer facilities, sewage was
settling in basements
in private homes and toilet facilities were
rendered unusable.
While the complaint is somewhat meager as to
specificity
of
violation,
the
details
on
which
the
violations
ax’e
asserted
can
be
determined
through
pre-trial
discovery,
and
undoubtedly
will be amplified at the hearing.
We conclude
that the complaint
is neither duplicitious nor frivo-
bus
and,
accordingly,
direct
that
the
matter
be
set
for
hearing.
