On May
3,
1972,
petitioner,
The Richardson Company, was granted
a variance with respect to air emissions from certain of its treating
ovens to July
1, 1972,whichon September
6,
1972, was extended to
December 31,
1972.
On December 29,
1972, we received a request for extension of
variance until January
31,
1973.
The combination of the late filing
of
this petition, the shortness of the period sought and the inability
of the Board to act until January 16,
1973,
(See Weinstein,
et al v.
Environmental Protection Agency,
#72—366, January 16,
1973)
precludes
consideration of this case pursuant to statutory requirements enabling
the Environmental Protection Agency to file its recommendation and
for
the
Board
to
make
a
determination
of
whether
a
hearing
would
be
appropriate.
Accordingly,
the
petition
for extension of variance is dismissed.
