Our Order of August 15, 1972 in Case #72-82 granted the
Village of Xenilw~~rthuntil December 31,
1972 to comply with
SWB-7 and the newly-adopted Water Pollution Control Regulations
with respect to the installation of sludge disposal facilities
for
its water treatment plant.
A construction schedule had been approved
by the Agency.
However, weather and lake conditions prevented compliance
with this program.
The present petition seeks a 90—day extension
of the December 31, 1972 compliance
date, which would bring
the date
of compliance
to March
31,
1973.
The Agency recommends allowance
of the variance,
subject to the conditions which we impose in our
Order.
The variance is granted.
IT IS THE ORDER of the Pollution Control Board that our Order of
August 15, 1972 be modified by extending the compliance date therein
provided from December 31, 1972 to March
31,
1973,
subject to all
conditions contained in said order as applicable to the Village of
Kenilworth, and subject to the following terms and conditions:
1.
That the variance extend only to the discharge of filter
backwash water and that any semi-annual discharge of sludge
should be prohibited during this period;
2.
That the petitioner submit monthly progress reports to the
Agency; and
3.
That the petitioner post a performance bond in the amount
of $3,000 within 10 days
of the date of the Board’s order
to assure compliance with Paragraphs
1 and 2.
