the Respondent’s herein,
to set Order aside or

clarification
of the same and other relief,and
it appearing that
an Amended Complaint was filed
on September
6,
1972,
in which
no asserted violations were charged against Dennis Chicken
Products Co.
It
is ordered that paragraph~sone and two of the
Order entered by the Board on December
5,
1972 be amended,
nunc pro tunc,
September 6,
1972,
to read as follows:
Ii.
Respondents Village of Augusta and Dennis Food Company,
a subsidiary
of Modern Foods Inc. cease and desist from the
violations
of
the Environmental Protection Act and our
Rules and Regulations which had been found to exist in this
Opinion.
2.
That Dennis Food Company,
a subsidiary of Modern Foods
Inc. pay to the State of Illinois by January
15, 1973 the
sum of $5,000 as a penalty for the violations found in
this proceeding.
Penalty payment by certified check
or money order payable to the State of Illinois shall be
made to:
Fiscal Services Division,
Illinois EPA,

Churchill Drive, Springfield,
Illinois 62706.’~
In all other respects said motion
is denied.
