By Order of the Hearing Officer, briefs were to be submitted
to the Board by December 12, 1972 in the above-captioned matter.
On that date,
no briefs having been received, order and opinion
were approved and issued by the Board finding Respondent to have
violated Section
9(b)
of the Act and Rules
3-2.110 and 3-2.111 of
the Rules and Regulations Governing the Control of Air Pollution.
A cease and desist order was entered and a fine of
$4,000
imDosed.
On December 13,
1972, Respondent’s brief was received by the
Board.
While the urief was not filed within the time st~ecified, in
fairness to the Respondent we have examined the brief with care
to
determine whether anything is contained therein which would cause
us to render
a decision different from that issued on December 12,
1972.
A thorough review of all arguments and contentions made
in the brief fails
to persuade us that our original order should
be modified in any respect, and, accordingly,
the ocinion and order
are reaffirmed as issued.
