ORDER
Petition for variance was filed by Minnesota Grain Pearling
Company requesting a variance with respect to the permit regulations
contained in the newly-enacted air pollution regulations. Hearing
has been previously authorized on this petition, and we are advised
that a hearing date has been set for December 28, 1972. The Agency
has filed a motion to dismiss the petition for variance alleging
failure to conform with our Procedural Rule 401.
While the petition is somewhat meager, we believe that the
deficiency can be corrected at the time of the hea~ringwithout any
undue disadvantage to the Agency, and accordingly, ‘the motion to
dismiss is denied.
