ORDER OF THE BOARD (by M. McFawn):
These cases are before the Board on (a) the “Motion for Extension of Time”
filed by Environmental Site Developers, Inc. (ESDI), complainant in PCB 96-180, on
July 21, 1997, seeking additional time to file its reply to respondent White & Brewer
Trucking, Inc.’s (White & Brewer) response to ESDI’s pending “Motion for Partial
Summary Judgment,” (b) ESDI’s “Motion for Leave to File Instanter” filed on August
4, 1997, regarding the same reply, and (c) White & Brewer’s “Motion for Leave to
File Supplement to Response to Motion for Partial Summary Judgment” filed on
August 4, 1997. The Board grants ESDI’s “Motion for Leave to File Instanter” and
White & Brewer’s motion and allows the filing of “ESDI’s Reply re Motion for Partial
Summary Judgment” and the “Supplement to White & Brewer Trucking’s Response to
Motion for Partial Summary Judgment.” In light of the granting of ESDI’s “Motion
for Leave to File Instanter,” ESDI’s “Motion for Extension of Time” is stricken as
    moot.
    IT IS SO ORDERED.

    Board Member K.M. Hennessey abstained.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, hereby certify
that the above order was adopted on the 7th day of August 1997, by a vote of 5-0.
