ORDER OF THE BOARD (BY SAMUEL T. LAWTON, JR.):
On October 3, 1972, we entered an Order granting an interim
variance to petitioner extending the variance previously granted
on October 14, 1971, as modified by Order of November 11, 1971
relative to the Company’s Will County and Powertown Generating
Stations, to December 15, 1972. The Order was premised, in part,
upon the Company waiving its statutory right to a decision on the
variance petition until December 15, 1972.
On December 11, 1972, we received a motion for extension
of interim variance to December 31, 1972, together with a waiver
of the right to decision until that date. The motion is granted
and the interim variance granted by our Order of October 3, 1972
is extended to December 31, 1972.
It is anticipated that the Board will take final action on
the basic variance request at its meeting of December 27, 1972.
