ENVIRONMENTAL PROTECTION AGENCY
#71—355
V.
CITY OF JACKSONVILLE
OPINION
AND
ORDER OF
THE BOARD
(BY SAMUEL
T.
LAWTON,
JR.):
The Environmental
Protection Agency has moved to dispense
with further hearing in the above-entitled cause on the grounds
that it has given general acceptance to Respondent’s program
with respect to removal of lime sludge and other contaminants
deposited in the Mauvaise Terre Creek, pursuant to our May 23,
1972 order.
On reviewing the various documents filed
in this proceeding
subsequent
to our order, ye are unable to discern 7recisely what
the Agency’s attitude is on t~ various alternative programs
submitted
by Respondent,
and accordingly,
direct that
the hearings
proceed
so that the
Board will be
fully cognizant
of
the program
proposed by
Respondent and the Agency’s attitude with respect
thereto.
Hearing heretofore
set by the Hearing Officer should be
continued
for approximately
2 weeks from
the date set,
in order
that both parties may be adequately prepared to proceed as directed
in this order.
I, Christan Moffett,
Clerk
of the
