coming
on

be
heard
on
motion

Staley
Manufacturing Company, petitioner herein,
to dismiss the portion
of the Environmental Protection Agency’s recommendation
character-
ized
as a cross—complaint with respect to odor emissions from
the company’s facility, and counsel for the Agency having orally
represented
that
it
joined
in
said
motion
on
the grounds that said
proceeding
would
best
be
adjudicated
in
an
enforcement
action;
IT IS HEREBY ORDERED that said cross-complaint with respect
to odor emissions be and the same is hereby dismissed and the
notice of hearing with respect thereto is vacated and set aside,
all of the foregoing without prejudice to either party to prosecute
or defend a proceeding with respect to odors from A.
E. Staley
Manufacturing Company’s facilities
in Decatur.
