    NEW HOPE MISSIONARY BAPTIST CHURCH
    #72—417
    v.

    ENVIRONMENTAL PROTECTION AGENCY

OPINION AND ORDER OF THE BOARD
    (BY SAMUEL
    T.
    LAWTON,
    JR.)
    New Hope Missionary
    Baptist
    Church seeks a variance from
our sewer ban order of March
31, 1971 entered in League of Women
Voters v. North Shore Sanitary District,##70-7,
    12,
    13 and 14,
to enable construction of a new church building that will dis-
charge its sewage into tributaries of the North Shore Sanitary
District North Chicago Sewage Treatment plant.
    By our order of October
    24, we directed that petitioner
    furnish additional information with respect
    to the contaminants
being discharged, the number of members
    in the congregation and
whether the new church premises, as proposed, will add any addi-
    tional load
to the facilities of the North Chicago
    plant.
    Peti-
tioner responded to our order stating that its membership ranged
    between
    75 and 100 ahd that 99
of the members lived in the area
served by the North Chicago Sewage Treatment plant and that their
use of the church facilities would not add any additional load
    to the sewage treatment plant.
The Agency recommends that the variance be allowed upon
    proof of petitioner’s allegations.
    We are satisfied with the
represent~’tionsas made in the petitions filed and grant the
    variance accordingly.
We have granted variances for institu-
tional uses where the proposed use of sewer facilities would be
in substitution of sewer facilities in the homes of members,
on the basis that the proposed use would not generate additional
sewage to the facilities of the North Shore Sanitary District.

    Petitioner has adequately demonstrated
that it falls within this doctrine and the variance so requested
    is allowed.
