Opinion of the Board
(by Mr. Currie):
Incinerator seeks a brief extension of the eleven months
allowed by our order of November 23, 1971,

for operation of scrubbing equipment to bring about compliance
with particulate emission standards.
As
a result of damage
to a component of the control equipment during delivery and of
unexpected delays in securing an electrical supply to
power the equipment, installation of the first scrubber was
expected,
the new petition alleged,to be completely installed
by November 1, 1972, testing to commence December 11,
1972,
and debugging to be completed by January 31,
1972.
By the
end of this period both scrubbers will be in full operation.
The Agency confirms that Incinerator has acted with diligence
to complete its control program and that the relatively
minor delays experienced were beyond the company’s control.
We agree the extension should be granted.
The Agency suggests
several conditions which we deem reasonable.
ORDER
The variance granted to Incinerator,
Inc. in 471-324
November 23, 1971 is hereby extended to
January 31,
1973,
on the following conditions:
1)
All applicable conditions of the prior order shall be met;
2)
A detailed progress report specifying every operation
which
has
not
been
completed
and
the
estimated
time
of
completion
for
each
operation
shall
be
submitted
to
the
Agency
by
December
14,
1972;
3)
A stack test shall be performed on or before December
15,
1972, or as soon thereafter as weather conditions
permit.
The Agency shall be notified five days in ad-
vance of the scheduled date of the stack test so that
Agency personnel may,
if desired, monitor the testing
procedures.
Stack test results shall be submitted to the
Agency by Jan.
31,
1973;

4)
Petitioner shall, within 5 days after receipt of this
order, inspect the mesh screen and,
if necessary, replace
it immediately.
