OPINION OF THE BOARD (BY SAMUEL T. LAWTON, JR.):
On December 2, 1971, in case Central Illinois Public Service
v. Environmental Protection Agency, #71-261, we granted a variance
tr
CIPCO allowing it to emit particulates in excess of the regula-
tions from Unit #1 at its Coffeen station until December 21, 1972,
subject to certain terms
and
conditions as therein provided pending
construction of an electrostatic precipitator, pursuant to schedule
which contemplated completion by March 9, 1973.
On September 22, 1972, we received a request for extension of
variance until March 9, 1973, which petition stated that construc-
tion of the electrostatic precipitator for Unit #1 was progressing
on schedule and that the unit would be removed from service on
March 9, 1973, as originally contemplated. The Agency recommends
that the variance be allowed, as proposed, subject to the following
coi~itions:
“(a) When there is a cutback in load, Petitioner shall
reduce the load on Unit No. 1 rather than Unit No. 2.
(b) Central Illinois Public Service Company shall submit
to the Agency monthly reports of daily generating loads for
Unit No. 1 and Unit No. 2, such reports to begin with the
month after the opinion in this case and shall continue until
March 9, 1973.
(c) Petitioner shall file a re~crt to the Agency apprising
said Agenc’j of the Progress of Unit Mo. i~spiecipitatci
installation. The first report is to he submitted within
two (2) weeks
after the opinion in this case and to continue
on a monthly basis until ccmoletion,
