    OPINION AND ORDER OF THE BOARD (by Mr. Seaman):
    On July 5, 1973, Petitioner, Illinois Power Company, filed with
    this Board its Petition to Extend Variance. Petitioner operates an
    electric power generating station known as the Hennepin Station
    located in Putnam County, Illinois. Petitioner, on July 14, 1972,
    filed a Petition for Variance for Unit 1 of its Hennepin Electric
    Generating Station. That Petition sought a variance to permit the
    operation of Unit 1 in excess of current particulate standards
    during those very limited periods when Unit 2 or its precipitator
    were inoperative, gas was unavailable and the output of Unit 1 was
    necessary for the reliability of electric service.
    On October 10, 1972, based on the Petition and other submissions,
    this Board entered its Order granting the variance, subject to
    certain specified conditions,, for Unit 1 until October 10, 1973, sub-
    ject to extension until June 30, 1974 (PCB71—l93).
    Petitioner alleges that it has complied with all the conditions
    of the original Order. Operation of Unit 1 in reliance upon the
    variance has been very rare and work is continuing on schedule for
    the precipitator on Unit 1. Petitioner believes, barring unforeseen
    occurrences beyond Petitioner’s control, that the precipitator for
    Unit 1 can be completed by June 30, 1974.
    The Agency is of the opinion that Petitioner has complied with
    all applicable conditions set forth in the Board’s Order in PCB72-297.
    Further, the Agency is of the opinion that Petitioner is on schedule
    for the installation of an electrostatic precipitator on Unit 1.
    Petitioner’s control program should put Unit 1 into compliance
    with the standards set forth in Rule 203(g) of Chapter 2, Part II
    of the Pollution Control Board’s regulations. Petitioner’s sulfur
    dioxide emissions are presently under the 6.0 lb/b6 BTU standard
    set f0rth in Rule 204. The Agency has received no comment from the
    public concerning this variance.
    This Opinion constitutes the findings of fact and conclusions
    of law of the Board.

    IT IS THE ORDER of the Pollution Control Board that variance
    be granted for the continued operation of Petitioner’s Unit 1
    until June 30, 1974, subject to the following conditions:
    1) All applicable conditions contained in the Board’s
    Order in PCB72-297 shall remain in full force and effect.
    2) Within thirty (30) days of the completion and startup
    of Unit 1, Petitioner shall have performed a stack test on Unit 1.
    Within five days of the date of said test, Petitioner shall notify
    the Agency of the date and time of said test and allow Agency
    observation if desired. Petitioner shall submit the results of
    said test to the Agency as soon as they are available.
