    OPINION AND ORDER OF THE BOARD
    (by Mr. Seaman):
    On May 25,
    1973, Petitioner, Illinois Power Company, filed
    with this Board its Petition to Extend Variance.
    Petitioner
    operates an electric power generating station known as Vermillion
    Station located in Edgar County,
    Illinois.
    That station consists
    of two pulverized coal-fired units and one oil fired fast start
    unit.
    On September 30,
    1971,
    after a hearing had been held,
    this
    Board entered its Order granting variances,
    subject to certain
    conditions, for Unit 1 until September
    30,
    1972, subject to extension
    until June
    30, 1973 and for Unit
    2 until September
    30,
    1973,
    subject
    to extension until December 31, 1973.
    It
    is Unit
    2 that is the
    subject of this variance request.
    Petitioner alleges that it has complied with the conditions
    of our previous Order and that it is impossible to complete the
    installation of the precipitator on Unit
    1 prior to June 30, 1973
    and to complete the installation of the precipitator on Unit 2
    prior to December 31,
    1973.
    The precipitator
    on Unit
    1 was completed
    and put into operation in June of
    1973 as required by the Order.
    Petitioner further alleges that work
    is continuing on schedule
    for the precipitator on Unit 2.
    Delivery of the precipitator com-
    ponents has begun,
    construction of the foundations is complete and
    the structural steel work is underway.
    Petitioner states that,
    barring unforeseen occurrances beyond Petitioner’s control, the
    precipitator for Unit
    2 can be completed by December 31,
    1973.
    Petitioner urges that continued operation of Unit
    2
    is necessary
    and essential if Petitioner is
    to maintain the reliability of the
    supply of electric power to the public and that maintaining

    the reliability of the supply of electric power is
    in the public
    interest and necessary thereto.
    On June
    5,
    1973,
    an Agency representative visited Petitioner’s
    facility to observe progress made in completing the electrostatic
    precipitators.
    The Agency is of the opinion that Petitioner has
    made good progress in completing the precipitators.
    Structural
    steel construction on the electrostatic precipitator of Unit 2
    began on June 4,
    1973 and many of the components have been delivered.
    Unit 2 is scheduled to come off line on November
    1,
    1973 and the
    precipitator on this unit should be completed in time to allow the
    unit to come back on line by January 13, 1973.
    The Agency has
    received no comment from the public concerning this variance.
    This Opinion constitutes the findings of fact and conclusions
    of law of the Board.
    IT IS THE ORDER of the Pollution Control Board that variance
    be granted for the continued operation of Petitioner~sUnit 2
    until December 31,
    1973 subject to the following conditions:
    1)
    All applicable conditions contained in the order of the
    Pollution Control Board in PCB71-197 shall remain in full force
    and effect;
    2)
    Petitioner shall perform a stack test on Unit No.
    2 within
    60 days of its start—up; Petitioner shall notify the Agency five
    (5)
    days in advance of said test and shall allow the Agency to observe
    the test if it desires.
    Petitioner shall provide the results of
    said test to the Agency as soon
    as they are available to Petitioner.
