    ORDER OF THE BOARD (by T.E. Johnson):
     
    On March 17, 2003, the Board received a motion for voluntary dismissal filed by Mac’s
    Convenience Stores, LLC (Mac’s). On December 19, 2002, the Board, at the parties’ request,
    extended until March 11, 2003, the time period within which Mac’s may appeal a November 6,
    2002 determination of the Illinois Environmental Protection Agency (Agency).

    5/40 (a)(1) (2002); 35 Ill. Adm. Code 105.406. The Agency modified a high priority corrective
    action plan and budget regarding a leaking underground storage tank site at 1952 East Court
    Street in Kankakee, Kankakee County. Because Mac’s failed to file an appeal prior to March 11,
    2003, the Board dismisses this case and closes the docket. The motion to dismiss is moot.
