Moticrn
to Dismiss filed June 18,
1973
states
that
the petition filed with
the Agency June 13
is inadequate
under the Board’s
Rule
401.
We agree.
We will not dismiss the petition
but will require
an amended
petition
to be filed with the Board and Agency within 30 days
of the date of this order.
Petitioner shall also file
a waiver
of
the 90-day decision period set by statute
to run from the date of
filing of the amended petition.
The petition should state the type and use of the boiler; the
emissions anticipated versus the standard;
the effects upon the
environment; the costs of compliance and the degree of hardship
involved in compliance.
If the petition
is not amended in
a timely fashion
it
shall be subject
to dismissal.
