OPINION AND ORDER OF THE BOARD (by Mr.Dume1le)~
Petition was filed with the Board on April 13 asking that a
variance be granted to permit sewer connections for seven single
family three bedroom residences to be constructed in Godfrey.
The petition is clearly inadequate. It does not tell the date
or type of ban or when it can reasonably be expected to be lifted.
We do not know if the ban was imposed because of an inadequate sewage
treatment lagoon or because of an inadequate sewer system or both.
The Procedural Rules of the Board require that a petition
contain a concise statement “of the injury that the grant of the
variance would impose on the public”. No such information is
given. We do not know the strength of the effluent now discharged
from the Warren Levis lagoon nor do we know of the present condition
of the receiving stream. No statement is given as to the effect
of the proposed variance on the effluent or on the stream.
The petition is dismissed for inadequacy without prejudice.
