OPINION AND ORDER OF THE BOARD (by Mr. Dumelle)
This is a petition for variance from Rule 203(b) of the Air
Regulations in regard to a grain dryer in Lincoln, Illinois. The
petition was filed on May 2, 1973. On June 15, 1973 we adopted
a grain dryer regulation which provides that grain drying and
conditioning operations need not comply with the requirements of
Rule 203 until May 30, 1975.
Therefore, there is no need for a variance in this case since
petitioner is now not in violation of Rule 203. The petition is
dismissed, without prejudice, as being moot.
