ORDER OF THE BOARD (by R.C. Flemal):
On January 16, 1997 the National Steel Corporation Granite City Division (GCD) filed
a petition for an adjusted standard from the Board’s water quality standards related to
ammonia. On January 23, 1997 the Board found the petition deficient and ordered GCD to
file an amended petition curing the deficiencies within 45 days, or the petition would be
subject to dismissal. On March 6, 1997 and May 1, 1997, at the request of GCD, the Board
stayed its order until July 7, 1997.
Currently before the Board is a July 3, 1997 GCD motion for continuance of temporary
stay and July 7, 1997 supplement to motion for continuance. GCD observes that it received a
copy of the Draft Renewal Permit which includes a thirty-day public comment period that
extends from July 6, 1997 through August 5, 1997. As a result GCD requests a stay in this
matter for an additional 60 days to allow it and the Illinois Environmental Protection Agency
(Agency) additional time to resolve the ammonia issue.
On July 9, 1997 the Agency filed its response and stated that it does not object to
granting the continued stay. In fact the Agency agrees with GCD that the issuance of the final
permit will resolve the issues in the instant matter, likely resulting in the withdrawal of the
adjusted standard request.
The Board hereby grants GCD’s requested stay until September 8, 1997. If GCD does
not file an amended petition by September 8, 1997, the petition for adjusted standard filed on
January 16
, 1997
will be subject to dismissal.
