Burry,
seeking variance
from our
order in League of Women Voters v. North Shore
Sanitary
District, #7O~-7, 12, 13, 14 (March
7,
1971) in
order
to connect a
flil~Te--family residence
to the
overloaded Waukegan sewers,
trioutary to the
North Shore Sanitary District,
Petitioner has failed to demonstrate that
he
would suffer
an
arbitrary
or unreasonable hardship if the
variance is denied. No
work has been
done on the property, either predating our sewer ban
order
or in expectation of the granting of
a
permit, nor are the
circumstances alleged
of
a
sufficient magnitude of hardship to
justify
a
relaxation
of
the sewer ban order. The increased costs of building
and services are not unique
to
petitioner.
We
again urge that the City of Waukegan take the necessary steps
to bring its sewer system into compliance so that construction of
the area can proceed. The petition for variance
is
denied without
prejudice.
