Petition was filed by
James
Clark seeking variance of our
order entered in League of Women Voters v. North Shore Sanitary
District, ##70—7, 12, 13 and 14 (March 7, 1971) 1 PCB 369, to
enable a sewer tie-in from his property to facilities tributary
to the Clavey Road sewage treatment plant, based upon inadequacies
of his septic system. The Board has previously granted variances
under such circumstances.
We have received a communication from the Lake County Health
Department indicating the unsatisfactory condition of the septic
field and the possible health implications if the situation is not
corrected. We believe the grant of the variance to be warranted
and it is so ordered. See Winsor v. Environmental Protection

IT IS THE ORDER of the Pollution Control Board that variance
be granted to James Clark to enable connection of his property in
Rockland Manor Subdivision to the facility tributary to the Clavey
Road sewage treatment plant.
