ORDER OF THE BOARD (BY SAMUEL T. LAWTON, JR.):
On October 24, 1972, we entered an order directing the
Village to immediately cease and desist dumping of all garbage,
refuse and trash at its landfill site, to take necessary steps to
adequately police the site to prevent future open dumping and to
provide final cover within 45 days of the receipt of the order.
On December 14, 1972, we received a communication on behalf
of the Village stating that the Village had complied with the Order
but that “the Village
was left with this
open area and feels that
it would be to the benefit of the Village if it were filled and
perhaps used for recreational purposes”. Allowance is sought to
dump inorganic material one—half day per week. It is difficult
to tell from the communication what provisions of the Regulations
petitioner seeks to have varied.
We have no objection to the dumping providing it does not
violate any applicable regulations and that the Village obtain
the necessary permits from the Environmental Protection Agency
consistent with the type of dumping proposed.
