REGIONALIZATION

ORDER OF THE BOARD

A motion to strike the report and recommendation of the

Hearing Officer with respect to Region VIII has been filed on

behalf of Urban Investment

& Development Company,

in which the

Company alleges various reasons for which the Hearing Officer

should disqualify himself, and takes exception to various portions

of the recommendation and report.

In addition, the Company challenges the legal capability of

the Board to enact the basic regionalization regulation, upon which

the hearings were based.

The motion is denied.

No facts are asserted which would dis—

qualify the Hearing Officer from conducting the hearings.

The

substa~tivearguments made to the recommendation and the legal

issues raised will be taken with the case at such time as

a final

Order is entered with respect to Region VIII.
