ORDER
Velsicol Chemical Corporation requests that we modify our Order
of April
5,
1973 by deleting the requirement that the Company post
a performance bond.
The request for reconsideration
is timely and we
consider
it
on its merits.
The Order requires Velsicol to cease and
desist from its violations by installing and operating a surface
facility for deep well injection of its plant effluent.
The posting
of
a performance bond in the amount of $150,000 for a period of one
year
is
to guarantee performance of the cease and desist order.
Velsicol would
like
to be relieved of
the
bond requirement
since
it
has completed construction of the surface facility.
The
Order, however, requires more than installation
of the facility.
It requires that the facility operate
in
an acceptable manner in
order to meet the requirements
of
the
law.
We
feel that the posting
of the bond for a period of one year
is a valid means of securing
the installation of equipment
which
will actually perform as
represented and will achieve the desired results,
i.e. compliance
with the Regulation.
The Request for Modification
is therefore denied.
