This letter is in reference to R03-9 dated February 20, 2003. I am the Standards
Director for the Acoustical Society ofAmerica. Recently, I received a copy ofthis
document and was surprised to see that much of the text ofproposed Sections
910.106 and 910.107 was taken almost word for word from ANSI Si 2.9 Part 3-1998
(R2003). Perhaps it was not noticed that this is copyrighted material.
The only revenue to support Standards development in the United States for
Standards of this type is sales ofthe Standard. Thus, no permission can be given for
you to use the text from ANSI S12.9 Part 3 in this fashion. We would be pleased if
you would reference the methods ofANSI Si2.9 Part 3. In any event, we hereby
require that you remove all copyrighted material taken from ANSI Si2.9 Part 3 from
your proposed rule. Further, we request that you ask all recipients of the R03-9
Proposed Rule dated February 20, 2003—Proposal for Public Comment to destroy
any and all copies of these two proposed sections; Section 910.106 and Section
910.107. Finally, please send us copies of your correspondence and the revised text
of the document demonstrating that these actions have been taken.
