ORDER OF THE BOARD (by R.C. Flemal):
On May 20, 1997 complainant filed a motion for partial summary judgment. On June 3,
1997 Electronic Interconnect Corporation (EIC) filed a motion for extension of time to respond
to complainant’s motion. EIC requested 90 days from the date of filing of complainant’s
motion. On June 5, 1997 the Board granted EIC an additional 20 days, for a total of 27 days or
until June 30, 1997, to file its response. On June 30, 1997 EIC filed a second motion for an
additional seven day extension, until July 7, 1997. On July 9, 1997 complainant filed a
response in opposition to the Board granting EIC’s second motion for extension of time.
The Board hereby grants EIC’s second motion for additional time to file its response to
complainant’s motion for partial summary judgment until July 7, 1997. Considering the date of
this order, July 10, 1997, the Board looks to its procedural rules to determine timeliness.
Pursuant to 35 Ill. Adm. Code 101.102(d), if documents are received after the due date, the
time of mailing shall be deemed the time of filing. Therefore if EIC’s response is postmarked
July 7, 1997 it shall be considered timely filed.
