ORDER OF THE BOARD (by Mr. Seaman):

Appellant’s motion to defer consideration of its appeal

from the denial of appellant’s application for an operating

permit for the coke oven operations of appellant’s Wisconsin

Steel Division, filed May 21, 1973, until the proceedings in

PCB 73-176 are concluded is sustained, on condition that

appellant files a waiver of the 90-day provision provided for

in Section 40 of the Environmental Protection Act.
