ORDER
The Agency has filed a Motion to Dismiss the variance petition.
The Motion to Dismiss is allowed since the petition fails to
comply with our Rule 401 in the following respects:
1.
The petition does not contain a concise statement
of the facts upon which the variance is requested
or an estimate of the quantity and type of con-
taminants to be discharged.
2.
The Petitioner does not say why he believes that
compliance with the regulations would impose an
arbitrary or unreasonable hardship, does not
describe the costs that compliance would impose
on the Petitioner nor the injury that the grant
of the variance would impose on the public.
The variance petition is dismissed without prejudice.
