OPINION AND ORDER OF THE BOARD (BY SAMUEL T.
LAWTON, JR.):
On March 3, 1971, in Case #70—48, we granted petitioner
the
right
to
burn its existing stock
ot

sulphur coal dur inq air
pollution episodes in the event of ari iriterruetion
of petitioner~s
natural gas supply.
The regu1~t:ion ,~~aa1d.otherwise require the
burning of
coal not in excess of 1 sulphur content.
This variance was extended on February 17, 1972 in Case #71-374
to February 17, 1973. The present petition seeks a further one—
year extension of the variance. We believe the circumstances which
justified the original allowance continue. However, the variance
is extended only until June 6, 1973. Any further extension of
this variance will be granted oniy upon a demonstration of extreme
economic hardship in meeting the requisite standards. Petitioner
should take steps to stock pile coal of sulphur content low enough
which,
when mixed with that presently stock piled, will result in
compliance with the Regulation. The dangers inherent in episode
conditions require compliance
with
the
emission regulations at this
time, above all others.
This opinion constitutes
the findings of fact and conclusions of
law of the Board.
IT IS THE ORDER of the Pollution Control Board that the variance
granted in Case #70-48 and extended by our Order in Case #71—374 is
extended to June 6, 1973, to permit Olin Corporation to burn its
existing stock of coal containing not more than 1.14 sulphur during
air pollution episodes under the following conditions:
1.
Olin
shall replace the coal, when consumed, with coal
meeting the regulation limits; and
2. Olin shall notify the Agency immediately in the event
a gas outage occurs during episode conditions.
I, Christan Moffett, Clerk of the Illinois Pollution Control Board,
certify that the above Opinion and Order was adopted on the 6th
Day of February, 1973, by a vote of 3 to 0.
