ORDER OF THE BOARD (BY MR. DUMELLE):
The petition of May 8 i~inadequate in that it does not give
the frequency of dosage with copper sulfate requested; the resultin~
concentrations of copper in the drinking water; the alternative of
using biodegradable algicides; or the period over which the variance
is required.
The Agency is asked to furnish the petitioner with recent
Board opinions on the subject for guidance (City of LaHarpe, et al
v. Environmental Protection Agency, #72-168, City of Paris, et al v.
Environmental Protection Agency, #72-277). The petitioner should
file an amended petition within 30 days and should also file a waiver
of the 90-day decision period for the same 30 days. Failure to
file the required information shall be grounds for dismissal because
of inadequacy.
