    OPINION AND ORDER OF THE BOARD (by Mr. Seaman)
    Complaint was filed on January 26, 1973 by the Illinois
    Environmental Protection

    Respondent, Inland
    Metals Refining Company, located in the City of Chicago,
    County of Cook, with violation of Section 9(a) of the Illinois
    Environmental Protection Act.
    The complaint alleges that certain baghouses operated by
    Respondent are inefficient and, therefore, constitute a
    continuing violation of Section 9 (a)
    The parties have submitted a Stipulation ~nd Proposal
    for Settlement, represented to be an agreement reached between
    the parties and represented to constitute the recommended
    disposition of the enforcement action.
    This Board finds that the Agency has presented no
    evidence of Respondent’s alleged violations to this date and
    that the public interest will best be served by a prompt
    resolution of this matter under the terms of the settlement
    suggested, and by avoidance of further costs and delays that
    will be incurred by a protracted hearing.
    The Board approves the maintenance procedures outlined
    in the Stipulation.
    This Opinion constitutes the findings of fact and
    conclusions of law of the Board.

    IT IS THE ORDER of the Pollution Control Board that
    Respondent, Inland Metals Refining Company, adopt and adhere
    to the following maintenance procedures:
    (a) Weekly Maintenance
    At least once each week,
    all of the bags are to be inspected by the Maintenance
    Superintendent and a crew. Bags which, upon visual
    inspection, have failed will be replaced, up to and including
    the entire unit if necessary. Bags which, in the judgment
    of the Superintendent, are susceptible to imminent failure
    will also be replaced. At the same time, all major equipment
    and duct work in or pertaining to the baghouse will be
    inspected and maintained in accordance with good operating
    procedure.
    (b) Daily Maintenance
    -
    From time to time during the
    calendar day an experienced maintenance man or a man exper-
    ienced in baghouse operations will examine the baghouse,
    with particular attention to stack emissions during operations.
    At any time during the calendar day at which stack emissions
    indicate possible violations of state regulations, the main-
    tenance man or a man experienced in baghouse operations will
    examine the baghouse, and will make necessary corrections,
    including replacement of bags, or seek to have the necessary
    corrections made by persons qualified to make the required
    repairs or corrections.
    (C) Records
    -
    Inland will maintain records of each day
    during which maintenance was performed on the baghouse. The
    records will contain a description of the type of maintenance
    performed.
    (d) Reports
    -
    Inland shall submit to the Agency quarterly
    reports regarding its compliance with the Air Pollution Control
    Regulations and the Illinois Environmental Protection Act.
