    Argonne Development Company requested variance from a
    sewer connection ban
    (ordered in League of Women Voters vs.
    North Shore Sanitary District, PCB 70-7)
    so
    as
    to permit
    construction of 270 housing units in North Chicago and con-
    nection of sewers and lines to the North Chicago Treatment
    Plant owned and operated by the North Shore Sanitary District.
    Argonne also requested variance to permit sewer connection of
    a supermarket and gasoline station.
    None of the facilities
    for
    which variance was sought are now in existence hut the intention
    is to construct the housing and commercial facilities when
    permission
    is given to connect them to
    the
    sewer.
    There is
    therefore no existing source of pollution involved in this
    proceeding.
    Petitioner Argonne Development Company now requests that
    it
    be
    permitted to withdraw the variance petition without
    prejudice to refiling at
    a later date.
    That motion is allowed.
    It is ordered that the variance petition be dismissed
    without prejudice.
