ORDER OF THE BOARD (by Mr. Dumelle):
The Motion for Non-Disclosure and for a Protective Order
filed October 11, 1973 by Allied Chemical Corporation is denied
without prejudice. Non-disclosure cannot be granted under the
present state of the petition since the material to be protected
is intertwined with the petition. To protect the material would
be to deny the public access to the petition.
Petitioner is ordered to redraft the petition in such fashion
that
it
can be made public and to place all material on which
non-disclosure is requested into an exhibit which can be protected
if the Board so rules. When the redrafted petition and new exhibit
are
filed, the petitioner shall also execute a waiver of the 90-day
provision for the period of time elapsing from the date of filing
of the original petition to the date of filing of the amended
petition.
Failure to execute the time waiver shall render the petition
liable to dismissal as not being adequate for public inspection and
perusal.
